Kitimat Council invites public comment before making a decision on a Development Variance Permit application.

The property owners of 30 Blueberry Avenue submitted an application for Council to consider a Development Variance Permit.  This application is for a setback variance to construct a lean-to extension onto an existing building. If approved, this permit would allow an encroachment of 4.26m into a 9m rear yard.

If approved, this permit would allow a garage with a height of 4.34m, where maximum height (average of peak to eave) is 3.0m.

The President of Clifford Condominium Estates, 20/30 Clifford Street, has submitted a Development Permit Amendment Application seeking pre-approval of covered porches and sheds. Development conditions would include a building or shed permit, compliance with an approved design, and matching colour and finishes of the associated dwelling.

Liquor Primary License Amendment Bylaw No. 1905

A public hearing will be held on Monday, 19 June 2017, at 7:30pm at Council Chambers, 606 Mountainview Square to consider ‘Liquor Primary License Amendment Bylaw No. 1905’

What is it? The proposed bylaw changes the Kitimat Municipal Code and Official Community Plan.

What changes?  With recent changes to the BC Liquor Control and Licensing Act, staff has prepared a bylaw establishing what land uses are eligible to hold a liquor primary license; and what land uses are ineligible to hold a liquor primary license.

Temporary Use Permit Application

Daudet Creek Contracting has submitted an application for a Temporary Use Permit (TUP) to operate a quarry on TL 9472 in the G5 Forestry Zone. Temporary Use Permits have been issued for this site since 1996.

The applicant is seeking a permit valid for the maximum three-year term allowed by the BC Local Government Act.  Renewal for a second three-year term in 2020 would require municipal approval. It is possible the District of Kitimat may consider a renewal request without a second notice to area business operations and land owners.

Where is it?

The quarry is accessible from Forest Avenue and Hirsch Creek FSR, approximately 1.2km from Highway 37 (click here for map).

Seeking Public Comment - Downtown Revitalization Area Development Permit, 327 City Centre

Status: approved.

What is happening? Rainforest Wellness has applied to install a LED backlit sign above their office door at 327 City Centre to reflect a name change (previously People’s Pharmacy). This sign is consistent with Kitimat’s Downtown Design Guidelines for fascia signs; the sign identifies business name only, has contemporary lettering and individually lit letters. Proposed sign will replace current sign.

Temporary Use Permit - 497 Quatsino

Status: Kitimat Council approved 2 year permit, expiring 19 December 2018.

Oviatt Contracting Ltd. has submitted an application for a Temporary Use Permit (TUP) for a home business address (company office) to employ people who do not reside on-site at 497 Quatsino Boulevard. Two permits have been issued to allow people who do not reside at this address to work in this office since 2011. A copy of the regulations that will govern this business, excluding business activity at the dwelling shall be performed only by person(s) resident in the dwelling, is attached for information.

A lease to continue occupation of this land by the Kitimat Flying Club for purposes of operating the Kitimat Air Park is under consideration by Kitimat Council. Term of lease is 27 years. Consideration to be received by the District in return for this agreement includes annual rent of $10 and continued Air Park operation and maintenance.

Ocelot Way Encroachment Easement to 0892818 B.C. Ltd. (a subsidiary of LNG Canada Development Inc.)

An easement and permission for the company and its related and subsidiary corporations to encroach on a public highway for site access and safety purposes, and to accommodate parts of a private storm sewer system and a private intersite water pipeline constructed under Ocelot Way (See Plan EPP66989). The term of the grant is ten years, and renewable without further public notice, for additional terms to a maximum total of fifty years. The consideration to be received by the District in return for this agreement includes commitments to maintain, repair, clean and clear Ocelot Way of snow and ice, and pay an annual licence fee of $1,000 (plus increases per Consumer Price Index after the initial term).

Loganberry Avenue Encroachment Agreement to Civeo Corporation

An easement and permission for the company to locate a private sewer forcemain within a portion of the dedicated roadway for Loganberry Avenue (See Plan EPP57319). The term of the grant of easement is until buildings on adjacent land that require the works are demolished (Lot 2 Plan EPP21889). The consideration received by the District in return for this agreement included construction of roadway and maintenance until April 2015 and a one-time payment of $4,000.

Public Hearing – Riverbrook Estates Zoning Amendment

Update: Public Hearing was closed on Monday, 15 February 2016. Kitimat Council gave Second and Third Reading to Zoning Amendment Bylaw No. 1878. Consideration of Adoption is held until Housing Agreement is formalized.

What Changes?

Riverbrook Estates Ltd. has submitted an application for Council to rezone a portion of Block 210; Plan 8918 (current civic address 167 Konigus St) to allow the development of a 5,272 sq m 70-unit manufactured home park. The site is currently zoned G5 – Forestry. The applicant is seeking that the site be zoned to R6-A Residential Zone - Manufactured Home on Individual Lot. The applicant is also seeking that a no build covenant be lifted and that a requirement to build 0.6m above the crown of the adjacent municipal road be introduced. Redevelopment of Manufactured Home Parks Policy

Update: Kitimat Council adopted policy on 23 November 2015. Policy can be found in staff report dated 19 November 2015. 

Staff have prepared a policy that lays out clear expectations for applicants and tenants and provides guidance to Council. The proposed policy would ensure tenants are notified of any rezoning application in advance of that application appearing before Council. This policy also provides a Right of First Refusal to existing tenants of homes constructed on-site, and outlines components to be included in relocation plan.

 Temporary Traffic Restriction Bylaw

In companion with the Encroachment Easement noted above, a traffic restriction bylaw outlines circumstances when temporary public access road closures may apply. Advance notice will be provided for all but emergency closures.

 Road Closing Bylaws (2)

Neither of the roads proposed for closure is developed (LNG Plant Road and Harbour Road). LNG Canada is assembling land for a proposed LNG liquefaction plant and has confirmed interest in adding areas of Harbour Road and LNG Plant Road to the project site. Closed road areas will be consolidated with abutting lots. Portion of Harbour Road will return to District of Kitimat in event LNG plant construction does not proceed. Consideration to be received includes appraised value of $181,000 for Harbour Road, $46,500 for LNG Plant Road and reimbursement of all municipal legal, land survey and public notice expenses.

Development Permit, 400 City Centre, District of Kitimat (Pool) - Amendment

Status: Approved

The District of Kitimat has submitted an application for exterior changes at 400 City Centre (Pool). The application is to change the cladding on the upper penthouse of the pool. Zoning Amendment, Hirsch Creek Golf & Winter Club

Kitimat Council is considering a proposed zoning change at 2000 Kingfisher Ave. Zoning proposal will legitimize the current land use of holes 3 and 4 at HCGWC and allow for potential public recreation and future trail development on land proposed for acquisition as municipal greenbelt.

The District of Kitimat initiated a zoning amendment application on behalf of Hirsch Creek Golf and Winter Club (HCGWC). Golf courses were permitted in Agricultural Land Reserves (ALR) until 1991. The establishment of HCGWC pre-dates the changes in legislation, resulting in a grandfathered use at this location. A change in zoning would allow HCGWC to be a conforming use and is supported by Kitimat’s Official Community Plan.

Local Area Service Tax - Commercial Ave.

The Council of the District of Kitimat is considering enacting a Local Area Service Bylaw to upgrade that portion of the public highway known as Commercial Avenue from the south boundaries of 716 Commercial Avenue (Lot A, District Lot 6063 and 6064, Range 5, Coast District, Plan 7181) and 717 Commercial Avenue (Lot B, District Lot 6063 and 6064, Range 5, Coast District, Plan 7181) to the north boundaries of 724 Commercial Avenue (Lot 1, District Lot 6063 and 6064, Range 5, Coast District, Plan 7389) and 725 Commercial Avenue (Lot 2, District Lot 6063 and 6064, Range 5, Coast District, Plan 7389) to the same standard as the existing paved portion of Commercial Avenue to the south.  The project will include all excavation, filling and installation of works necessary to complete the curb, gutter and paving.

Public Notice - Local Area Service Tax.tiff 

The estimated cost of the project is one hundred seventy-eight thousand dollars ($178,000).  Eighty-nine thousand dollars, ($89,000) would be paid for from general municipal tax revenue and eighty-nine thousand dollars ($89,000) would be paid for by a local service tax imposed in the form of a parcel tax on the benefitting parcels noted above.  The cost apportioned to each parcel would be twenty-two thousand, two hundred fifty dollars ($22,250). The parcel owners’ portion of the costs would be added to the annual property tax bill and paid in ten (10) equal payments over ten (10) years.

Development Permit Application, 1851 Kingfisher

Update: Development Permit Application for 1851 Kingfisher was approved by Council on 14 December 2015.

McFadden Management Ltd. has applied for a five-building, 40-unit townhouse complex at 1851 Kingfisher Avenue. Three buildings are proposed to front onto Kingfisher Avenue, with parking behind the buildings. Two buildings are perpendicular to Kingfisher Avenue. Development layout reflects the advice of a geotechnical engineer. A nine metre setback from crest of slope is provided, as the remainder of the lot comprises of a ravine. This Development project complies with current zoning. A Development Permit is required to approve exterior finishes and landscaping plan.

Proposed location is north of Margetts Street on “Kingfisher North”, a driveway built to access the Hirsch Creek Golf & Winter Club. As a part of this development, the applicant will be responsible to bring Kingfisher Avenue North to municipal standard, including moving utilities underground, installing curb and gutter on east side of street, and providing a walkway connected to the walkway at the intersection of Margetts and Alexander.

Application to Open and Operate a Quarry/Borrow Pit - Daudet Creek Contracting


What is Happening?

Daudet Creek Contracting Ltd. has submitted an application to Ministry of Forests, Lands and Natural Resource Operations (FLNRO) for permits needed to open and operate a 36.83ha quarry and borrow pit on lands described as parts of DL 6183, 6184 and 6165 Range 5 Coast District. Referral to Kitimat Council follows discussion at the staff level.  In addition to provincial approvals, this quarry and borrow pit will need a Temporary Use Permit from the District of Kitimat. 

Proposed location is on Provincial Crown land, east of Highway 37, between Hirsch Creek Park and Cable Car Neighbourhood. The northern most point of the application area is approximately 1.6 km South of Oolichan Avenue.

LNG Canada Zoning and OCP Amendment

What Changes?

LNG Canada wishes to rezone several areas that are currently zoned G6-A – Environmentally Sensitive or M1 – Manufacturing to align zone boundaries with the LNG Canada project site. Eight areas now zoned G6-A would become M1 (17.05 ha), and six areas now zoned M1 would become G6-A (20.15 ha). There is a net gain of 3.1 ha of protected land.  LNG Canada also requests Official Community Plan schedules be amended to reflect any approved zoning changes. Kitimat Council is considering a  Zoning and OCP Amendment and is seeking public input.

Seeking Public Comment - Coast to Coast Development Permit

Kitimat Council invites public comment before making decisions on a proposed Development Permit application.

Coast to Coast Holdings has submitted an application to consider a Development Permit for 1015-1050 Alexander Avenue.  This application is to enable the construction of seven 12-unit apartment buildings, one 5-unit townhouse building and one 4-unit townhouse building.  Proposed development has been reduced since first proposed, from 105 to 93 total units.  Map showing site plan and one apartment elevation follow on reverse side.

This site is subject to a rezoning application, Bylaw 1864, which has received three readings from Council. A Development Permit must be issued prior to construction, which governs siting, layout, and character of buildings and landscaping.

Public Hearing - Forest Hills Heights Rezoning

Kitimat Council is considering a proposed zoning change at Forest Hills Heights Subdivision. Council is considering relocating the local park component of Phase 6 of this ongoing subdivision. A Public Hearing will take place on 23 March 2015, and you are invited to participate. Maps of property location and proposed site layout are provided on the following page.

Wakita Construction Ltd. has submitted an application for Council to relocate the local park component of Phase 6 of the subdivision, in conjuncture with a revised site layout. Total number of units in this phase remains unchanged. Proposed location of park will tie in to current informal trail connecting Wakita Ave with Hirsch Creek Trail. As a part of this rezoning, Wakita Construction is proposing sponsoring upgrades to the trail connection. Council is considering ‘Forest Hills Zoning Amendment Bylaw No. 1864, 2015.’, and is seeking your input.

Seeking Public Comment - Exchange of Park Land

Kitimat Council intends to adopt the HTC Park Closing and Exchange Bylaw 1863, 2015, and adjust a park boundary to facilitate construction of an access to Haisla Town Centre (HTC) at 879 Lahakas Boulevard. The preferred alignment of this intersection requires adjusting the boundary of a park at the intersection of Haisla and Lahakas Boulevard North. 

Park size will not change. A 100.1 square metres of park area will be “closed and exchanged” for an equal area of abutting land that will be dedicated and as park and added to the existing park. Adoption of HTC Park Closing and Exchange Bylaw 1863, 2015 is subject to elector assent as determined through alternative approval process outlined in S. 86 of the BC Community Charter.

Eligible voters who object to adoption of this bylaw are encouraged to sign a petition objecting to the park exchange. This petition is available for signature at 270 City Centre, between the hours of 8:30 am to Noon and 1:00 pm to 4:30 pm weekdays. You are eligible to vote if you are:

  • 18 years of age or older on April 13;
  • Canadian citizen;
  • Resident of British Columbia for at least six months before April 13;
  • Not disqualifed under the Local Government Act, or any other enactment from voting in a local election, or otherwise disqualifed by law;

AND

  • You lived in Kitimat for at least 30 days before April 13; OR
  • You owned property in Kitimat for at least 30 days before April 13.

Council may consider bylaw adoption on April 13 if no more than 10% of electors (460 eligible voters) have signed the petition objecting to proposed park exchange. Comment may also be delivered c/o dok@kitimat.ca or 270 City Centre, Kitimat V8C 2H7 up to 8:30am, April 9; or in-person at the Council meeting, April 13, 7:30pm, at 606 Mountainview Square.

Public Hearing - 1015-1050 Alexander Development

UPDATE: The Public Hearing has been adjourned to Monday February 23, 2015 at 7:30pm at Council Chambers, 606 Mountainview Square to consider proposed changes to Kitimat's Municipal Code regarding proposed development at 1015-1050 Alexander Ave. The lot is currently zoned R3-A.

What Changes?

Coast to Coast Holdings has applied to amend the zoning regulations for 1015-1050 Alexander Ave (currently known as the Alexander Townhouses), to permit the construction of eight, 12-unit apartment buildings; a five-unit townhouse building, and a four-unit townhouse building. Total development proposed is 105 units, an increase of 25 units from current zoning. To facilitate development, property would be placed in a new Zone (R3-D), which would allow for smaller minimum lot area per unit, greater lot coverage, increased Floor Area Ratio, and maximum height of 12 metres. Development proposal would also require decreased minimum lot frontage, relaxation of parking standards, and a front yard variance for one building.

Council is considering ‘1015-1050 ALEXANDER R3-D MULTI-FAMILY RESIDENTIAL ZONE BYLAW NO 1861, 2014’ to allow this development, and is seeking your input. Coast to Coast Holdings will also be applying for a Development Permit for this proposal. Development Permits govern siting, layout, and external appearance of the development.
