Kitimat Municipal Code (Bylaws)

The Kitimat Municipal Code contains all the regulatory bylaws of the District of Kitimat.  This is unique in British Columbia.

The code is available below  as a complete document as well as in sections. These versions are not official. You can get official versions by contacting us.

Bylaw Enforcement

Enforcement of Kitimat's bylaws, and the issuing of penalties, is largely the responsibility of the Bylaw Enforcement Department.

A violation ticket received in Kitimat is called an MTI, which stands for Municipal Ticket Information. A municipality has authority to issue MTIs under the Local Government Act and the Community Charter.

While bylaw investigations can be started through observation by a Kitimat bylaw officer, in many cases investigations are thanks to reports by community members.

All reports must include:

  • location and general nature of the bylaw contravention; and
  • the complainant's name, address and contact information (such as a telephone number or email).

The District does not accept anonymous bylaw complaints.

Bylaw Enforcement

 

Bylaw Enforcement

The Bylaw Enforcement Department is responsible for the enforcement of Kitimat's bylaws and the issuing of Municipal Information Tickets (MTI). The following Council policies are directly related to Bylaw Enforcement:

At the April 7, 2025, meeting of Council, the following bylaw enforcement direction was provided:

"THAT application of section 1.3.4 of the Bylaw Enforcement: General (B-02) Policy include enforcement for the following offences:

  • Nuisance Properties (9.12.2 of the Kitimat Municipal Code) – overgrown lawns
  • Nuisance Properties (9.12.2 of the Kitimat Municipal Code) – accumulation of waste
  • Parking (3.4.10-3.4.17.1 of the Kitimat Municipal Code) – parking offences" (R25-096)

Making a Bylaw Complaint

Bylaw inquiries, complaints or concerns can be directed through the bylaw department. Depending on the nature of the bylaw complaint, other departments may be consulted. For example, a complaint related to land use may be referred to the Planning department or an animal control related offence may be referred to the Kitimat Humane Society.

In accordance with Policy B-02 - Bylaw Enforcement Policy - General, a bylaw complaint must include the following information:

  • location and general nature of the bylaw contravention; and
  • the complainant's name, address and contact information (such as a telephone number or email).

The District does not accept anonymous bylaw complaints. 

 

Bylaw complaints can be reported through the bylaw complaint form, by email at bylaw@kitimat.ca, or in person at 270 City Centre, Kitimat, BC.

Complaints related to specific District employees may be made directly to Human Resources at HR@kitimat.ca. 

 

Complaints not related to bylaw offences may be made through the general complaint process (see below). 

 

Municipal Ticket Information (MTI)

The District of Kitimat uses the Municipal Ticket Information (MTI) system.

 

You can find additional information about MTI on the province's website. 

 

 Disputing a Municipal Ticket Information (MTI)

Municipal Ticket Information (MTI) are issued in accordance with Bylaw Enforcement Policy - General (B-02).

 

For more information on how your Dispute Notice will be managed, please refer to Bylaw Enforcement Policy - Municipal Ticket Information (B-11).

 

Details on disputing the MTI are located on the back of the MTI. 

 

If you wish to dispute your MTI, your Notice of Dispute must be delivered within fourteen (14) calendar days of the date of service of the MTI. You may also obtain a Notice of Dispute through Municipal Office reception, by emailing bylaw@kitimat.ca, or downloading the Notice of Dispute.

 

You are not required to use the Notice of Dispute form provided. A Notice of Dispute must be delivered within fourteen (14) calendar days of the date of service of the MTI and include the following: 

  • Ticket Number (located top right corner of the MTI)
  • Full Name and Mailing Address
  • Date of Offence
  • Bylaw Name and Section

 

If your Notice of Dispute does not provide sufficient information to identify the MTI, you may be deemed not to have disputed same

 

Notice of Dispute may be delivered:

  • in person: Municipal Hall at 270 City Centre, Kitimat (during regular business hours)
  • by mail: District of Kitimat, Attn: Bylaw Officer, 270 City Centre, Kitimat, BC V8C 2H7
  • by email: bylaw@kitimat.ca 

A Notice of Dispute may not be made over the phone. 

 

If you have any questions regarding disputing your MTI, please contact bylaw at bylaw@kitimat.ca or by phone at (250) 632-8900. 

Paying a Municipal Ticket Information (MTI)

A Municipal Ticket Information (MTI) fine becomes payable to the District fourteen (14) calendar days after service of the the MTI, unless the MTI is disputed.

 

You can pay your MTI fine: 

  • cash, cheque or electronic payment (debt, credit card) in person: Municipal Hall at 270 City Centre, Kitimat (during regular business hours)
  • electronic payment (debt, credit card) by phone: (250) 632-8900
  • cheque via mail: District of Kitimat, Attn: Bylaw Officer, 270 City Centre, Kitimat, BC V8C 2H7

Please reference the ticket number (top right corner of the MTI) with payment.

Unpaid Municipal Ticket Information (MTI)

A Municipal Ticket Information (MTI) fine becomes payable to the District fourteen (14) calendar days after service service of the MTI, unless the MTI is disputed. Please see above for details on paying your MTI fine. 

 

Unpaid Municipal Ticket Information (MTI) will be collected in accordance with Bylaw Enforcement: Municipal Ticket Information (MTI) Policy B-11. 

Animal Control Complaints (Including Barking Dogs):

Contact the Humane Society at 250-639-6297 or online reporting here.

Bylaw complaints related to Animal Control may be referred to the Kitimat Humane Society. 

If the animal control issue presents an immediate risk to the public, please contact the RCMP through the non-emergency line at (250) 632-7111 or call 9-1-1.

Noise Complaints (Not Barking Dogs):

Details of noise violations are found in Part 9, Division 12, Subdivision 1. 

During District of Kitimat operating hours, please contact the District of Kitimat Bylaw Department at 250-632-8900 ex 2268.

Outside District of Kitimat operating hours, including weekday after hours, weekends and statutory holidays, please contact the (RCMP non-emergency) at 250-632-7111. 

Complaints regarding a District Employee:

If you have a complaint regarding a specific employee, please submit your complaint directly to Human Resources at HR@kitimat.ca. 

All Other Complaints:

Please use the general complaint form for complaints not related to bylaw enforcement.

This may include concerns about:

  • District services (such as snow clearing, road maintenance, water quality);
  • District facilities (including buildings, campgrounds, and parks); or
  • General complaints about the District and our activities.

You may submit this complaint anonymously. This complaint is distributed through a general mailbox to  the appropriate department. 

Complaints related to a bylaw contravention can be made through the bylaw complaint form (see above).

Complaints related to specific District employees may be made directly to Human Resources at HR@kitimat.ca.
