Notice is hereby given, pursuant to Section 227 of the Community Charter, that Council will be considering first three readings of Permissive Tax Exemption Amendment Bylaw No. 2071, 2025 at the Council meeting on October 6, 2025, at 7 pm.

  

Permissive tax exemptions must be approved by bylaw on or before October 31 in any year in order to apply for the following year.

Temporary Use Permit Renewal - 2150 Forest Avenue 
 

PURPOSE

The purpose of the application is to allow for renewal of a previously issued TUP that permitted a mobile concrete batch plant (TUP 02-2022) at 2150 Forest Avenue.  Under the Local Government Act, TUPs may be issued for a maximum of three years and may be renewed once for up to an additional three years. The applicant is requesting a renewal of TUP 02-2022 for an additional three years.

The Kitimat Official Community Plan (OCP) permits temporary uses in all Industrial M-Zones. The subject property is zoned M3 Maintenance Depot Zone in the Kitimat Municipal Code (KMC). The M3 zone indicates that temporary uses are permitted in accordance with Part 9, Division 8 of the KMC. Division 8 includes the processing of natural materials as a permitted temporary use for industrial zones.

PURPOSE:

The purpose of the TUP is to permit the operation of a home-based business that prepares and supplies pre-made meals, with weekly customer pick-ups scheduled from the residence. Home occupation is not permitted under the R1-A zoning regulations. Therefore, the TUP is being sought to allow this activity for a limited term, subject to conditions that ensure compatibility with the surrounding residential neighborhood.

PURPOSE:


The purpose of the application is to permit a temporary laydown yard for storing construction equipment and materials, housing office trailers, and marshalling crews related to the Cedar LNG project. Under the Local Government Act (LGA), TUPs may be issued for a maximum of three years and may be renewed once for up to an additional three years. The applicant is requesting a TUP for the maximum three years to support construction of the Cedar LNG facility


The proposed TUP area is limited to the lands hatched on the location map below, zoned G5 Forestry. A laydown yard is not an outright permitted use in the G5 Forestry zone; however, the Kitimat Official Community Plan (OCP) allows for the consideration of temporary uses in Forestry (G5) zones. The G5 zone indicates that temporary uses are permitted in accordance with Part 9, Division 8 of the Kitimat Municipal Code (KMC), and Division 8 states a TUP may be issued for a commercial or industrial activity in the G5 zone. A laydown yard is an eligible industrial activity for consideration of a TUP.

PURPOSE

Please be advised that an application has been submitted for a Downtown Revitalization Area (DRA) development permit to upgrade the appearance of nine existing window frames at 578 Mountainview Square, as shown below. This application pertains to the property and land within the District of Kitimat, as indicated on the attached location map.

The DRA Development Permit guidelines are outlined in the Kitimat Official Community Plan (OCP), which provides direction for the form and character of development within the City Centre. Section 38(3) Liqour Control and Licensing Act

PURPOSE

The District of Kitimat Council has received a referral from the Liquor and Cannabis Regulation Branch (LCRB) for an application by PF Pizzeria & Bistro for a Patron Participation Entertainment Endorsement application. A summary of the application is as follows:

The Applicant provided these details in the application to the LCRB:

 

“We would like to host live music and open mic events in our establishment this would take place on our stage area in the deli seating section. We also have a table hockey machine, that is not a paid machine but to use for patrons who are dining in or waiting for take out orders to use as a fun way to pass time, this is an open table and requires no money to start as its battery operated.”

 

Properties within 90 m of 238 City Centre will be mailed this notice. The notice will also be posted on the District of Kitimat website, on the District bulletin boards, posted on Facebook and Get Involved Kitimat, published in the Northern Sentinel, and posted at PF Pizzeria and Bistro.

TAKE NOTICE that pursuant to Section 26 of the Community Charter, the Council of the District of Kitimat hereby gives notice that it intends to dispose of land that is not being made available to the public for acquisition:

The District is proposing to dispose, through a Statutory Right-of-Way, a portion of Ocelot Way to Cedar LNG Partners (GP) Ltd. for the purpose of installing and operating a pipeline.

The Statutory Right-of-Way will, no later than December 31, 2027, be converted to a specific statutory right-of-way to reflect the constructed pipeline. The costs to survey and register the specific statutory right-of-way will be borne by Cedar LNG Partners (GP) Ltd.

The District will receive $13,500 in compensation for the disposition of this portion of Ocelot Way.

TAKE NOTICE that pursuant to Section 26 of the Community Charter, the Council of the District of Kitimat hereby gives notice that it intends enter into an agreement to lease land that is not being made available to the public for acquisition:

The proposed disposition is for the lease (the “Lease”) of Lands at the Public Safety Building to the Canadian Broadcasting Company (CBC) for a five-year term (expiry November 2029). The Lease is intended to allow the CBC to occupy space for the continued use of antennas and broadcasting
equipment.


Following notice under section 26 of the Community Charter, the Corporate Officer is authorized to execute the agreement.


The Lease provides rent revenues of $2400 annually and the District of Kitimat utilizes a portion of the antennas for its communication equipment.

Notice of proposed disposition is given in accordance with section 26(3) of the Community Charter for a Lease that would provide exclusive access and use of construction site and laydown area portions of DL 471 during supplemental work for salt marsh (re)construction.  Proposed term is three years less a day.  Consideration for this (second) term includes; Lease payment of $150,000 for land use and access to water; snow clearing and road maintenance on DL471 and access route from Kitamaat Village Road outside of DL471; and other consideration, including recovery of legal expenses.

The corresponding Licence that was approved in 2018, and became effective in 2021 already provides non-exclusive access over DL 95 and DL 471 to monitor salt marsh performance for a term of ten years, plus up to ten one-year renewals thereafter. It is also being amended to attach the amended and restated Lease and update LNGC company information, the Participants and notice particulars.

PURPOSE:

The purpose of this application is to amend the zoning for 1442 Nalabila Boulevard Zoning amendment Bylaw No. 2063, 2025, proposes to retain the site’s C4 zoning but make changes to the conditions of use to allow one additional commercial use and one additional dwelling unit for the store operator.
