PURPOSE The purpose of the application is to allow for renewal of a previously issued TUP that permitted a mobile concrete batch plant (TUP 02-2022) at 2150 Forest Avenue. Under the Local Government Act, TUPs may be issued for a maximum of three years and may be renewed once for up to an additional three years. The applicant is requesting a renewal of TUP 02-2022 for an additional three years. The Kitimat Official Community Plan (OCP) permits temporary uses in all Industrial M-Zones. The subject property is zoned M3 Maintenance Depot Zone in the Kitimat Municipal Code (KMC). The M3 zone indicates that temporary uses are permitted in accordance with Part 9, Division 8 of the KMC. Therefore, the TUP is being sought to allow this activity for a limited term, subject to conditions that ensure compatibility with the surrounding residential neighborhood.
